The availability of cheaper generic medicines for the people who does have little purchasing power is helpful for a developing country, but when it comes to an economy with a higher standard of living and with high expectations, then it becomes a problem.

Our society tolerates alcohol consumption and the ills associated with it because most citizens use alcohol responsibly. In a free society, we cannot prohibit activities just because some people cannot behave properly. If we punished everyone for the bad decisions or misbehavior of a few, we would have to make driving, procreation, buying houses, using credit cards, and many other things illegal.

They can build on it, they can improve it, but they cannot immediately copy it,” adds Giovanetti. That perhaps simply adds another brace to the argument put forward by Chakraborty and Singhvi for pharmaceuticals in the developing world.

"After all, one cannot imagine companies agreeing to a legal compulsory licensing system for music, movies, or even software." I beg to differ. In China, for just example, the government simply ignores patent and copyright ownership. It has been said that a substantial portion of Chinese government computers operate with pirated software. And China does not stand alone in this arena. Compulsory licensing is but one form of theft of another's work. Has Atlas shrugged yet?
